Maximum one (1) entry per person and per household and per email address during the Contest Period regardless of entry method.

Limitations applicable to all methods of entry: The use of multiple identities and/or accounts is prohibited, and any attempt to obtain more than the stated number of entries will void that participant’s entries and may result in participant’s disqualification.  Incomplete, forged, altered, automated, mechanically-reproduced, lost, late, postage-due, misdirected, garbled or illegible entries will be disqualified.  Sponsor will not be responsible for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender, Sponsor, or Sponsor’s Donation Tracker.

In the event of a dispute, Sponsor will determine who submitted the disputed entry in Sponsor’s sole discretion. All entries become property of Sponsor and none will be returned. Any questions regarding the number of entries submitted shall be determined by Sponsor in its sole discretion, and Sponsor reserves the right to disqualify any entries by persons who submit false or misleading entry information or who Sponsor determines to be tampering with or abusing any aspect of the Contest.

5.         Winner Selection and Odds.

On or about Monday, February 1, 2016, Sponsor will select twenty (20) potential First Prize Winners and fifteen (15) potential Second Prize Winners in a random drawing from among all eligible entries received during the Contest Period and then share that information with a representative of CMG for the purpose of distributing prizes.

Odds of winning depend on the total number of eligible entries received.

6.         Prize Description.

Twenty (20) First Prizes:  Subject to verification of eligibility and compliance with these Official Rules, twenty (20) First Prize Winners will each receive one (1) $100 gift certificate to Spa Sydell.

The approximate retail value (ARV) of each First Prize:  $100.00

Fifteen (15) Second Prizes:  Subject to verification of eligibility and compliance with these Official Rules, fifteen (15) Second Prize Winners will each receive one (1) certificate to Workout Anytime for a basic one (1) year membership.

ARV of each Second Prize:  $249.00

Total ARV of all prizes to be awarded in the Contest:  $5,735.00

Gift certificates are subject to certain terms and conditions as specified by issuer.  Sponsor is not responsible for, and will not replace, lost, mutilated, or stolen gift certificates.  No refund or compensation will be paid in the event Spa Sydell or Workout Anytime, or any of their participating locations, closes or is unavailable.

Limit:  Only one (1) prize winner may be selected from the same household every sixty (60) days in connection with any contest sponsored or administered by any of the CMG-Atlanta radio stations (i.e., WSB-AM, WSB-FM, WSBB, WTSH, WALR and WSRV).   If you or a member of your household has won a prize from any CMG-Atlanta radio station within the last sixty (60) days, you will be ineligible to receive a prize in this Contest.

7.         Winner Notification and Acceptance.  Potential winners will be notified by a representative of CMG on or about Monday, February 1, 2016 at the telephone number and/or email address provided at the time of registering a donation receipt at http://gwdonate.org.

In order to accept a prize, potential winners must respond to notification within twenty-four (24) hours of notice or attempted notice.

To claim a prize, potential winners must personally visit the offices of CMG at 1601 West Peachtree Street NE, Atlanta, Georgia 30309 within thirty (30) days of notification. Office visits must be between the hours of 8:30 a.m. E.T. and 5:30 p.m. E.T. weekdays.

For identification purposes, all winners must show CMG in person or provide a copy of either i) a valid Georgia driver’s license or Georgia state-issued ID or ii) another government-issued photo ID and a utility bill to show proof of Georgia residency. Winners are also required to complete a liability and publicity release, which must be signed at the time a winner claims his/her prize at CMG’s offices. Failure to sign the release or to present the required identification and proof of residency will result in a winner’s disqualification and the forfeiture of his or her interest in a prize.

The inability to reach a potential winner after a reasonable (as solely determined by Sponsor and CMG) effort has been made, the failure of a potential winner to timely respond to a prize notification, the return of any prize notification as undeliverable, and/or a potential winner’s failure to comply with any term or condition of these Official Rules may, in Sponsor’s sole discretion, result in the potential winner’s disqualification and the selection of a substitute winner by a random drawing from among all remaining eligible entries received during the Contest Period.  Sponsor will conduct up to two (2) alternate drawings, after which the prize will not be awarded.

A PARTICIPANT IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL SPONSOR HAS COMPLETED ITS VERIFICATION OF PARTICIPANT’S ELIGIBILITY.

A winner may waive the right to receive a prize. Prizes are non-assignable and nontransferable and cannot be redeemed for cash. No substitutions are allowed by winners. Prizes and individual components of prize packages are subject to availability. Sponsor and CMG reserve the right to substitute prizes or components of prize packages with a prize or component of equal or greater value. Winners are solely responsible for reporting and payment of any taxes on a prize. A winner may be required to provide his/her valid Social Security Number to Sponsor or CMG for tax purposes and/or complete an IRS W-9 form in order to claim a prize.  Winners are solely responsible for all federal, state and local taxes on prize value and, as applicable, will be issued an IRS Form 1099 based on the prize value determined by Sponsor and CMG. Prizes not won and claimed by eligible winners in accordance with these Official Rules will not be awarded and will remain the property of Sponsor.

8.         Publicity.  Except where prohibited, participation in the Contest constitutes each winner’s irrevocable consent to the publication of his or her name in on-air promotional announcements produced by CMG on behalf of Sponsor.

Each winner further grants Sponsor, CMG, and their affiliates, digital properties, and advertising, promotion and production agencies, permission to use his or her name, address or likeness in any and all advertising and promotional materials, in any manner or media whatsoever, including websites operated by Sponsor or CMG, for purposes of advertising, trade or promotion, without additional compensation.

Each winner acknowledges and agrees that he or she shall have no right of approval, no claim to any compensation, and no claim arising out of the use, alteration, or distortion of his or her name or address.

9.         Participation.  By participating, participants agree to be bound by these Official Rules and the decisions of Sponsor and any Contest judges or administrators selected by Sponsor, which are final and binding in all respects.  Sponsor reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Contest as solely determined by Sponsor.  In the event the Contest is compromised by a virus, non-authorized human intervention, tampering or other causes beyond the reasonable control of Sponsor which corrupt or impair the administration, security, fairness or proper operation of the Contest, Sponsor reserves the right in its sole discretion to suspend, modify or terminate the Contest.  Should the Contest be terminated prior to the stated expiration date, Sponsor reserves the right to award prizes based on the entries received before the termination date.  Proof of sending or submission of an entry will not be deemed proof of receipt by Sponsor.

10.        Release.  BY PARTICIPATING IN THE CONTEST, EACH PARTICIPANT AGREES TO FULLY RELEASE, FOREVER DISCHARGE AND HOLD HARMLESS SPONSOR, COX MEDIA GROUP, LLC, COX ENTERPRISES, INC., SPA SYDELL, WORKOUT ANYTIME AND THEIR RESPECTIVE SUBSIDIARIES, AFFILIATES, SUPPLIERS, DISTRIBUTORS, ADVERTISING/PROMOTION AGENCIES, AND PRIZE SUPPLIERS AND EACH SUCH COMPANY’S OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, AND SUCCESSORS AND ASSIGNS (COLLECTIVELY, THE “RELEASED PARTIES”) FROM AND AGAINST ANY CLAIMS, COSTS, LIABILITIES, LOSSES, INJURIES, AND DAMAGES ARISING OUT OF THE CONTEST, INCLUDING, BUT NOT LIMITED TO, ANY CLAIMS FOR PERSONAL INJURY, DEATH, OR DAMAGE TO OR LOSS OF PROPERTY, LOSS OF ENJOYMENT, OR ANY OTHER HARM WHATSOEVER ARISING OUT OF: (1) PARTICIPATION IN THE CONTEST; (2) THE QUALITY, RECEIPT, POSSESSION, USE, OR MISUSE OF ANY PRIZE; OR (3) ANY TRAVEL OR ACTIVITY THAT IS RELATED TO THE CONTEST OR ANY PRIZE.

11.        Limitations of Liability. By PARTICIPATING IN the Contest, PARTICIPANTs acknowledge and agree that EVERYTHING REGARDING THIS CONTEST, INCLUDING THE prize(S), ARE provided “as is” and that Sponsor makes no representations or warranties OF ANY KIND, express or implied, about the Prize(S) and sponsor hereby DISCLAIMS all such warranties, including, but not limited to, any implied warranties of merchantability or fitness for a particular purpose.  (BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN IMPLIED WARRANTIES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IN SUCH STATES, THE LIABILITY OF THE RELEASED PARTIES IS LIMITED TO THE FULLEST EXTENT PERMITTED BY SUCH STATE LAW.)

The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by PARTICIPANTs, printing OR PRODUCTION errors, or by any of the equipment or programming associated with or EMPLOYED in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest, the processing of entries, or the notification of any winner; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from A PARTICIPANT’S participation in the Contest or receipt or use or misuse of any prize.

Only the number of prizes stated in these Official Rules is available to be won in the Contest.  In the event that production, technical, seeding, programming, or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award the prizes by a random drawing among all legitimate eligible prize claims.

12.        Construction. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any contestant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with the laws of the State of Georgia, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Georgia, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of Georgia.  The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision.  In the event that any such provision is determined to be invalid or otherwise unenforceable, these Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.

13.        Miscellaneous.  Sponsor will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials or announcements relating to the Contest.  Sponsor reserves the right to amend, suspend or cancel the Contest at any time.  For a list of winners (available after Friday, February 5, 2016) or a copy of these Official Rules, send a self-addressed, stamped envelope to “Winners List” or “Official Rules” (as applicable), Goodwill’s Healthy Holiday Makeover Promotion, 1601 West Peachtree Street NE, Atlanta, Georgia 30309.  If you have any questions regarding this Contest, please contact the Promotions and Marketing Department of CMG via email at justin.tysinger@coxinc.com or mail at 1601 West Peachtree Street NE, Atlanta, Georgia 30309.

If for any reason a Participant’s entry is confirmed to have been voided or corrupted by any grossly negligent act of the Sponsor, Participant’s sole remedy is another entry into the Sweepstakes, subject to availability and provided that this Sweepstakes has not then expired.

Only the number of prizes stated in these Official Rules is available to be won in the Sweepstakes. In the event that production, technical, seeding, programming, or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award the prizes by a random drawing among all legitimate eligible prize claims.

4.         How To Enter.

There are two (2) ways to enter the Contest, each listed below. During the Contest Period, you may enter the Contest via both methods listed below. However, you may only be selected as a winner one (1) time during the Contest Period regardless of number or method of entry.

(A)   CALL-IN ENTRY TO B98.5

To enter, listen to Sponsor’s radio broadcast on B98.5 (the “Broadcast”) weekdays at the following times: 9:05 a.m. ET, 12:05 p.m. ET, 2:05 p.m. ET, and/or 5:05 p.m. ET (each, a “Listen Time”). During each Listen Time for each weekday during the Contest Period, Sponsor will give a “Cue to Call” telling potential entrants to call in for a chance to win. When you hear the Cue to Call, call Sponsor’s “Contest Line” at 404-741-0985 to try to be the 25th caller. Subject to verification of eligibility and compliance with these Official Rules, the 25th person to call Sponsor’s Contest Line, as solely determined by Sponsor, will be declared a winner.

To qualify as a winner via Call-In Entry, (a) you must be listening to the Broadcast at the time the Contest cue to call is given; (b) you must be declared by Sponsor to be the 25th person to call Sponsor’s Contest Line at 404-741-0985; and (c) you must comply with all other terms and conditions of these Official Rules.

(B)   MOBILE APP ENTRY

You may enter via the Sponsor’s mobile app during the Contest Period.

To enter, you must complete the following steps (standard data rates may apply):

  1. Download and install the “B98.5” mobile app (the “App”) on a compatible mobile device from either Google® Play or the iTunes® App Store.
  2. Once you have installed the app, click the “Holiday Bill Pay” tab on the App’s main menu to register for the Contest.  Follow the instructions on the registration page to submit an official entry form.  All of the required information must be provided, and all of the information you provide must be complete and accurate.  Entrants who submit an invalid phone number or email address may be disqualified in Sponsor’s sole discretion.

An entry received through the Sponsor’s mobile app, consistent with these Official Rules, will result in one (1) entry for the Contest. Limit one (1) entry per person and per email address during the Contest Period regardless of whether you enter via the Android App or the iOS app.  Failure to complete any of the steps in this section may result in the disqualification of your attempted entry as determined in Sponsor’s sole discretion.  Sponsor is not responsible for any issue that may prevent a contestant from being able to download or access the app or complete his/her entry.

By participating in the Contest via Sponsor’s mobile app, you agree to be bound by the app’s terms of use and privacy policy.

Limitations applicable to all methods of entry: The use of multiple identities and/or accounts is prohibited, and any attempt to obtain more than the stated number of entries will void that participant’s entries and may result in participant’s disqualification. Incomplete, forged, altered, automated, mechanically-reproduced, lost, late, misdirected, garbled or illegible entries will be disqualified. Sponsor will not be responsible for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender, Sponsor, or Sponsor’s Contest application service provider.

Any winning participant must be the person who originally dialed the phone number to the Contest Line, or submitted an official entry form via Sponsor’s mobile app, as applicable, to participate in the Contest. No family members, friends, office associates, or any other person will be allowed to participate in the Contest on another person’s behalf. A winner must provide his or her own name as listed on his or her valid Georgia driver’s license or Georgia state-issued ID. If a winner uses a false name, an invalid Georgia driver’s license or Georgia state-issued ID, or another person’s Georgia driver’s license or Georgia state-issued ID, he or she will be immediately disqualified from the Contest and be ineligible to win any prize.

Limitations applicable to any call-in method of entry: Listeners accessing Sponsor’s radio station audio via IP connections like website-based streaming or mobile devices are welcome to enter. However, Sponsor cannot be responsible for delays in electronic transmission of station audio to IP devices. By entering this Contest, listeners acknowledge and agree to this specific provision of these Official Rules. In addition, Sponsor will not be responsible for loss of service to the Contest Line or for a participant’s failure to reach the Contest Line due to malfunction of any network or system, congestion, any technical or human error, failures or malfunctions of any kind, including the congestion, overload, busy signals, or any other factor that may prevent an individual from completing his/her phone call. In the event of interruption of power or telephone service to Sponsor during a call-in period of the Contest prior to accepting the 25th caller, or a change in programming that results in Sponsor’s inability to air a call-in opportunity, Sponsor will not replay the affected call-in opportunity and the number of opportunities to win a prize in this Contest will be reduced accordingly. If a 25th caller is ineligible, or fails to comply with any term of condition of these Official Rules, that caller will be disqualified, and Sponsor will resume the call-in opportunity and declare the next caller a winner, pending verification of eligibility and compliance with these Official Rules.

Telephone calls will be taken by Contest operators in the order they are received, and the operators will count the number of calls received after each on-air Contest cue to call to determine the 25th caller. The determinations of Sponsor and Contest operators will be final and binding in all respects. Enter as often as you like during the Call-In Entry Period, provided that the use of automatic telephone dialing equipment or other software or computer-assisted dialing tools is prohibited and may result in your disqualification.

In the event a 25th caller gets disconnected for any reason before being declared a winner, Sponsor may resume the call-in opportunity affected and declare the next caller a winner, pending verification of eligibility and compliance with these Official Rules. Sponsor will not be responsible for dropped calls from mobile devices or land lines and dropped calls may result in a potential winner’s disqualification and forfeiture of all interest in any prize.

5.         Winner Selection and Odds.

CALL-IN ENTRY (156). Four (4) potential winners will be selected via Call-In Entry each weekday, excluding Monday, January 18, 2016, for a total of one hundred fifty-six (156) winners during the Contest Period. The odds of winning via the Call-In Entry depend on the total number of people attempting to call the Contest Line when the Cue to Call is given and the order in which the calls are received. Each Call-In Entry winner will receive the Prize defined below.

MOBILE APP ENTRY (1). On or about Monday, February 29, 2016, Sponsor will select one (1) potential winner by random drawing from among all eligible mobile app entries received during the Contest Period who will also receive the Prize defined below. The odds of winning via Mobile App Entry depend on the total number of eligible entries received during the Contest Period.

6.         Prize Description.

Each winner further grants Sponsor, and its affiliates, digital properties, and advertising, promotion and production agencies, permission to use his or her name, address or likeness in any and all advertising and promotional materials, in any manner or media whatsoever, including websites operated by Sponsor, for purposes of advertising, trade or promotion, without additional compensation.

In the event the Contest is compromised by tampering or other causes beyond the reasonable control of Sponsor which corrupt or impair the administration, security, fairness or proper operation of the Contest, Sponsor reserves the right in its sole discretion to suspend, modify or terminate the Contest.  Should the Contest be terminated prior to the stated expiration date, Sponsor reserves the right to award prizes based on the entries received before the termination date.  Proof of sending or submission of an entry will not be deemed proof of receipt by Sponsor.
